Five states have enacted new DUI & DWI laws in 2010
Five U.S. states have enacted new laws related to drunk driving in 2010.
- Iowa – Iowa House Files 2233 and 2452 relate to driver's license sanctions including the issuance of temporary restricted licenses and specific requirements relating to ignition interlock devices. This law also provides for penalties, allowing the issuance of a temporary restricted license to a person with a suspended or revoked non-commercial driver's license without requiring a court order to do so. - Maine – Maine House Bill 1137 allows a person who committed a 2nd or 3rd DUI offense prior to a specified date to apply for early termination of a driver's license suspension as long as that the person installs an ignition interlock device in his/her vehicle. - New Jersey – New Jersey Assembly Bill 3073 states that an ignition interlock device is required for all DUI offenses and requires installation during license suspension. This bill also adds a new section to existing law regarding the cost of the device and its installation for people within with lower income groups. - New Mexico – New Mexico Senate Bill 32 increases the fee charged for chemical and other tests used to determine the influence of liquor or drugs. The fee is raised from $65 to $85. (go to http://www.legis.state.nm.us/lcs/_session.aspx?chamber=S&legtype=B&legno=%20%2032&year=10 )
- Wyoming – Wyoming Senate File 19 would make it illegal for a driver to have a blood alcohol concentration of .08% within two hours after the time of driving or being in control of a vehicle. In addition, it changes the number of repeat offender violation years from 5 years to 10. Now, a second conviction within ten years after a previous conviction will require prison time between 7 days and 6 months. A fourth conviction within 10 years will result in a felony conviction.
